Accuracy and updating of content

Vinauro informs users that, unless another size is specified, all wine bottles available in our catalog have a capacity of 75 cl, and those of spirits 70 cl.

Legal age of users

This merchant undertakes not to allow any transaction that is illegal, or is considered by the credit card brands or the acquiring bank, which may or has the potential to damage their goodwill or negatively influence them. The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all laws applicable to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. Additionally, the following activities are also explicitly prohibited:

Sale of alcoholic beverages to minors under 18 years of age.

Prices

The prices of our products and services are expressed in euros and include the VAT in force in Spain at the time of contracting. In the case of alcoholic beverages (wines and spirits), prices also include the excise taxes in force in Spain at the time of purchasing each product.

In the case of placing an order destined for one of the territories in which Vinauro can make deliveries but VAT is not applicable, as soon as the destination is indicated in the purchase process, our system will deduct the amount of said tax of all quantities subject to purchase. The amount of VAT applied is reported in the invoice summary detail that is presented to the user on the last page, just before confirming their purchase.

Although Vinauro reserves the right to modify its prices at any time, its products and services will be invoiced based on the rates in effect at the time each order is registered.

Vinauro does not assume any responsibility for any possible typographical or arithmetic error that may appear in the prices indicated on its pages but undertakes to correct it as soon as possible, to notify the error and the new amount to the clients who have contracted the product or affected services and to offer them, in the event that they do not accept the new price, the right of cancellation as long as the delivery of the purchased products has not yet taken place. In the event of partial or total cancellation of the content of the order for this reason, Vinauro undertakes to fully refund the amount paid within a maximum period of 7 calendar days and always using the same method used for payment.

The total amount of orders requested from Vinauro includes the price of the products, the cost of transportation and insurance against possible loss or breakage, plus the corresponding taxes mentioned above (VAT and, in the case of alcoholic beverages, current special taxes in Spain); this amount is valid and complete for deliveries to any country in the European Union, except special territories. In the case of special territories or non-member countries of the European Union in which Vinauro makes deliveries, the order amount does not include Spanish VAT but also does not include import costs, tariffs and local taxes, which will be borne by the recipient. They must be paid directly to the transport agency at the time of delivery and for which the client cannot demand any responsibility from Vinauro.

Availability

Vinauro maintains minimum stocks in its warehouse of each product advertised as available on our pages. These stocks vary depending on each reference and have been calculated to cover their usual demand, in normal times and situations. In addition, Vinauro has established, with its different suppliers, distribution agreements so that new stock is delivered to its warehouse within reasonable deadlines, which are usually less than a week.

Vinauro reserves the right to limit the purchase of certain products to a certain number of units or bottles, as well as to require a minimum number of purchase units; this limitation or minimum requirement will be announced at the time of making the purchase, either directly on the website or through written communication in the case of making the purchase by email.

Vinauro reserves the right to cancel an order due to lack of availability regardless of the information published on the website at the time of registering the order and the customer having received confirmation by email; Vinauro reserves this right of cancellation due to lack of availability both for its normal sale and advanced sale products, as well as in the case of offers and promotions. However, in case of lack of availability, Vinauro undertakes to notify the buyer as soon as possible, offer the possibility of replacing it with another product of similar price (in the case of choosing a product with a higher price, a variation of up to 5% of the price paid) or to partially or totally cancel your purchase. Likewise, in case of limited and insufficient availability to cover all the requests received, Vinauro reserves the possibility of assigning a maximum number of bottles or units per customer and/or order; al locations will be made in strict order of receipt of orders.

Vinauro does not assume any responsibility for any possible damage that a lack of availability could cause to the user, even having received the initial confirmation of the order, on the website or by email, but undertakes to refund the amount paid for the products. not available within a maximum period of 7 calendar days from the moment you receive the cancellation request from the client.

Payment methods and bank fees

All orders must be paid in full in advance by bank card (VISA debit or credit and Mastercard).

In the event that Vinauro must make a refund by bank transfer to a client’s account, regardless of the reason for the refund, it must be from a bank in a country belonging to the European Economic Area; If the client requests a refund to a bank account belonging to a country outside this area, any commission will be charged for transfers to accounts in countries that are not members of the European Economic Area. Refunds on cards or bank accounts from member states of the European Economic Area will be made with the full agreed amount.

Vinauro reserves the right to limit the amount of payments to be made by card.

Invoices

Vinauro issues its invoices exclusively in PDF format, in a file that the user can receive by email with the details of each order. The purchasing user renounces, by accepting these General Conditions of Use and Sale, receiving them in paper form.

For customers who are citizens of non-EU member countries, Vinauro offers the possibility of recovering the Spanish VAT paid when formalizing their order. To do this, the client must return by postal mail a printed copy of the invoice issued by Vinauro stamped by the customs of the community country from which the products have been seen leaving the European Union. It is essential that this copy arrives at the Vinauro registered address with the original customs seal within a maximum period of three months from the date of confirmation of the purchase. Vinauro offers this service completely free of charge but reserves the right to stop providing it at any time.

Deliveries

Vinauro makes every effort to ensure that the information published on our pages about stock replenishment times and delivery times is as accurate and real as possible. These deadlines are calculated and reviewed based on accumulated experience but may present slight deviations due to transport incidents for multiple reasons, unforeseen local holidays or exceptional periods such as Christmas or situations of high demand such as the launch of exceptional promotions or other reasons. Vinauro makes every effort to keep its customers informed of any exceptional delays but cannot assume any responsibility due to failure to meet any estimated date: delivery dates are estimated and not guaranteed, except for the maximum of 30 calendar days established by the law.

The contracted transport conditions for the standard or economy service are for a delivery during the day, from Monday to Friday, without prior notice or the possibility of agreeing on delivery at a specific time, and with only a single delivery attempt guaranteed. If the recipient is not at home when the first attempt is made, they must contact the carrier to find out if a new delivery is possible without additional cost or if otherwise it will be necessary to travel to their branch to pick it up. The time during which the order can be picked up at the office indicated by the carrier if delivery to the indicated address has not been possible will depend on each agency. Vinauro does not exercise any control over the storage times for undelivered orders in transport agencies and, consequently, cannot assume any responsibility if the order has not been collected within that time and is finally returned to origin; in which case, Vinauro will be forced to charge the corresponding return costs to the customer, as well as reshipping costs if you want the order to be sent again.

In the case of requesting an urgent delivery service or under special conditions (refrigerated transport) and this is possible, the only guarantees and compensations will be those offered by the carrier, which will be communicated by Vinauro to the client and accepted by him through communication by email.

The user undertakes to provide only correct and complete data at all times but especially when indicating delivery addresses, especially taking into account that any surcharge caused by the need to modify a delivery address once the order has been sent, it will be at the customer’s expense.

Vinauro undertakes to provide the client with an estimated delivery date, as well as the data necessary to track each shipment whenever provided by the agency, but it is the client’s responsibility to ensure that there will be someone at the indicated address at the time of delivery, both for your own orders and, and especially, for gifts. The estimated delivery date for shipments with standard or economy service may not be exact, it is not a guaranteed date, and Vinauro cannot be responsible for its variation.

Delivery of orders to PO boxes is not possible. Orders must be received by adults, who must indicate on the delivery note their name and signature (and ID number in some countries), assuming responsibility for custody of the packages in the event that they are not the recipients of the same. If any anomaly is detected at the time of delivery (lack of packages or visible damage), the recipient must indicate it on the delivery note before signing it and immediately notify the Vinauro Customer Service Department. The customer has 24 hours to complain about any incident related to delivery or possible content error. In order to have the right to make a claim, the original packaging in which the products arrived must be preserved.

Vinauro undertakes to replace any product not received or received damaged during transport as long as the claim is made within the period and conditions established above. If replacement with the same product is not possible, the customer may choose another product of similar price or request a refund of the amount paid for it.

In the event of loss or loss of part or all of the order, Vinauro will proceed to claim the shipment from the transport company but must wait a reasonable period of time for the agency to locate it before proceeding to replace it. The maximum waiting period will be 7 calendar days from the notification of the incident by the client.

Cancellations and returns

The customer has the right to request the cancellation of an order at any time and to receive a refund of the entire amount paid except from the moment in which it has entered the preparation phase; once in preparation, shipped or delivered, to cancel an order or return it, whether part or all of its contents, the customer must avail himself of the right of withdrawal or the right of return, the conditions of which are also specified below.

In those cases in which the order has not yet entered the preparation phase, it will be enough for the client to request its cancellation by email, although they must take into account that there may be a delay between receipt of the message and its reading and management period of time during which the order may have entered the preparation phase and it is not possible to stop its shipment.

Once canceled, Vinauro undertakes to refund the entire amount paid within a maximum period of 7 calendar days. To do this, the same method used for payment will always be used, except in the case of credits by transfer to bank accounts belonging to a non-EU country, in which case the client may choose between (1) accepting the impact of any commission that could be generated as transfers to accounts in countries that are not members of the European Economic Area, (2) facilitate another alternative modality, either a Pay account.

In the case of returns to bank accounts or cards from countries with a currency other than the euro, given that the amount to be returned will be in euros – as was the payment – and in order to avoid unnecessary commissions, the client may also request to leave the amount as credit for a future purchase.

In the event that the payment method used at the time of purchase is no longer available (expired card), the customer may request a refund on another account, a refund by transfer (with the reservations detailed above for bank accounts belonging to non-EU countries), or also leave the amount as credit for a future purchase; In no case may it be on a card other than the one used to pay for the order.

Once the preparation of the order has started, is ready for shipment, shipped or delivered, any cancellation request will be treated as the right of withdrawal. To exercise the right of withdrawal, the client must communicate their decision in a clear way, free of any ambiguity: either (1) by postal letter, addressed to the Vinauro headquarters at 7 Carcel Alta Street, Granada, or (2) by email addressed to at.cliente@vinauro.com. The return of the order in case of withdrawal will also give rise to the refund of the entire order, including shipping costs, except in the case of having requested, for the original shipment, a shipping method with a higher cost than the basic one; In this case, only the amount corresponding to a standard service will be refunded as shipping costs.

In case of withdrawal, Vinauro will be the one who will organize and assume the costs of the collection and transportation to its warehouse of the products to be returned, and will do so through one of its collaborating agencies and according to the usual conditions of a standard service, that is that the client must allow the collection of the products during the day, without the obligation to specify a specific time by the agency. Collection must be made at the same address where the delivery of the original order took place. If the client requests collection at another address, this must be previously confirmed by Vinauro, who reserves the right to request payment of the difference in the event that the cost of transportation for collection at this new address is higher to the one that would cause the collection at the original address.

No returns will be accepted for deliveries made to special territories or countries not members of the European Union.

Every customer has the right to withdrawal without the need for justification as long as they make use of their right within a period of 14 calendar days from the date of delivery of the order, according to communication from the transport agency, or from the return of the order to the transport agency in case of failed delivery or repeated absence. The right of return due to withdrawal cannot be exercised when there are indications that the products have been opened, manipulated or exposed to inappropriate conditions. And it is mandatory to return the entire shipment in this case, with all products properly protected, in their original packaging and in perfect condition for subsequent sale.

Once the order has been recovered and the appropriate checks on the status of the products have been carried out, Vinauro will refund the customer the entire amount paid, using the same method used for payment, with the same exceptions and reservations mentioned in the third, fourth and fifth paragraphs of this same section regarding credits by transfer into bank accounts belonging to a country outside the EEA as indicated, accounts with currencies other than the euro and modalities not available.

The refund in the case of withdrawal will be made within a maximum period of 14 days from the date of receipt of the returned order. Returns for postage due or claims for payment of invoices for organized shipments by the customer will not be accepted. And it will be necessary to insert a completed copy of the Return Form in the box; If the order was made up of more than one package, a copy of it in each one.

The customer also has the right to return part or all of an order if any of the products received – except in the case of collector bottles, without the right to claim or return – do not meet their expectations or they realize, after delivery, having purchased it by mistake, involuntary or induced by any erroneous or incomplete information published on our pages. In this case, the period to request the return will be 30 calendar days and must be proceeded in the same way and with the same reservations mentioned for the right of withdrawal for both collection and subsequent refund. The form to be used will be the same Return Form that is used in the case of withdrawal, it being necessary in this case to indicate the name of each of the products to be returned; once completed, it must be sent by email to the Vinauro Customer Service Department to agree on the terms of collection; once agreed, the customer must insert a copy of the form in the return package; if the return includes more than one package, it will be necessary to insert a copy in each box. The refund in this situation – a partial return of an order, or after the 14 days provided for by the right of withdrawal – will only be for the products returned in perfect condition, excluding both the shipping costs paid for the original shipment and any supplement paid. as gift options (paper or wooden box).

In the event of a content error, Vinauro undertakes, after receiving notification of the problem by email, to collect the products sent in error and send you the correct products as soon as possible, always according to availability and usual replenishment times, or to refund the amount paid for the products purchased and not shipped plus the proportional part of the transportation, if the situation arose in which the new delivery no longer arrived on time for the purpose for which they had been acquired. In the event of a possible lack of availability or delay, Vinauro will offer the customer the possibility, if desired, of exchanging the product out of stock or affected by the delay for another of similar price. The client will not have the right to claim any type of compensation for the inconvenience caused by an error of this nature and the period to request a refund in this case will also be 30 calendar days.

In the event of an incident during transport (partial or damaged deliveries, delivery to the wrong address, loss of packages or unacceptable delays once the order has been shipped), the customer has the right to a replacement shipment as soon as possible. In such eventualities, it will be essential to record the problem on the delivery note and always communicate the incident within the deadlines established by each transport agency (often just 24 hours after delivery). If reshipping is not possible or if it no longer arrives on time, the customer will have the right to credit for products not received in perfect condition as well as a proportional part of the shipping costs.

The customer also has the right to return a defective product, whether the defect affects its contents (corked wine or other defect) or its exterior (damage to labels, capsules or other decorative elements). In case of damage to the exterior, the customer must notify the problem within a maximum period of 30 days from the date of delivery of the order and initially present a photograph that allows the problem to be observed; For wines with a defect, the period is one year and, in communicating the claim, the customer must indicate the batch code of the bottle, usually indicated on the back label. Both problems must be reported, within the aforementioned deadlines, by email to the Customer Service Department, who will inform the customer as soon as possible, and always within 3 working days, whether the products will be collected or not, since either to verify the defect or to present it to the producer for analysis or claim. Until a response is received, the client must keep the bottle, with a minimum of 3/4 of its contents and covered with its original cork if it has been opened. Whether it is collected or not, the customer will receive a credit for the amount paid for the product, shipping excluded. If the product is collected, the customer must fill out the Return Form and facilitate the collection, which may take place at the same delivery address or at another address if this has been agreed in writing with the Customer Service Department to the Vinauro Client.

To make any return effective, in any of the cases described in this section, it is essential to first contact our Customer Service Department to warn of the situation. Vinauro will not accept any claim or return if we have not previously received any notification by email and the terms thereof have not been agreed.

Applicable law and jurisdiction

The General Conditions of use and sale set out here are subject to Spanish legislation and the Spanish version will be the only one with legal validity and the one that will prevail in the event of a discrepancy between the versions published on the different Vinauro websites.

The place of celebration of the sale to which these General Conditions are subject will be determined in accordance with the provisions of Council Regulation (EC) 44/2001, of December 22, 2000, relating to judicial jurisdiction, recognition and execution of judicial resolutions in civil and commercial matters.
